NOTICE OF OWNERSHIP AND ENFORCEMENT

This Legal Notice governs your use of the Christian DISC® Assessment, related materials, and services provided through christianpersonalitytest.com (the "Website") by Christian DISC®, which is owned and operated by Arizona Christian Counseling LLC (dba Prism Counseling & Coaching) ("Company," "we," "us," or "our").

By accessing or using our Website, purchasing our assessments, or utilizing any of our services, you acknowledge that you have read, understood, and agree to be bound by this Legal Notice and all applicable laws and regulations.

1. NOTICE OF OWNERSHIP & INTELLECTUAL PROPERTY

Christian DISC® is a federally protected trademark (USPTO Serial No. 88355911). All materials—including assessment tools, scoring methods, PDF reports, biblical insights, training content, and system architecture—are the exclusive property of Arizona Christian Counseling LLC.

Unauthorized use, reproduction, or adaptation of these materials is prohibited under U.S. trademark and copyright law.

2. PERMITTED USE & "INTERNAL VS. PROFESSIONAL" TEACHING

The purchase of Christian DISC® assessments grants a limited, non-transferable license based on the type of purchase:

Internal/Informal Use: If you have purchased a Group Discount Package, you are permitted to reference the Christian DISC® name and use the materials for informal, internal training and team-building within your own organization or ministry.
Professional/Commercial Use: You may not use Christian DISC® materials to provide professional coaching, consulting, training, or facilitation services for external clients or for profit unless you are a Certified Christian DISC® Facilitator.
Prohibitions: You may not rebrand, modify, or sell the Christian DISC® system or its individual reports.

3. CERTIFICATION & TEACHING AUTHORITY

Arizona Christian Counseling LLC is the sole certifying authority for the Christian DISC®.

Only Certified Christian DISC® Facilitators in good standing have the authority to:

Identify as a "Certified Christian DISC® Facilitator."
Provide professional coaching or facilitation services using the Christian DISC® framework.
Lead workshops or group sessions for external organizations.

4. REFUND POLICY SUMMARY

Assessments: Due to the nature of digital products, all sales of individual and group assessments are final and non-refundable once access is provided.
Certification Course: We offer a 30-day, "no questions asked" refund policy for the online certification course if you are not satisfied with the program.
Physical Products: Returns are accepted within the specified window in our full policy.

5. PROFESSIONAL ADVICE DISCLAIMER

The Christian DISC® Assessment and its reports are for educational and spiritual growth purposes only.

Not Therapy: This tool is not a substitute for professional mental health counseling, medical advice, or clinical diagnosis.

6. ACCURACY OF RESULTS

Reports are generated based on user-provided answers. Christian DISC® does not guarantee the accuracy of results and is not liable for how individuals or organizations interpret or act upon the findings.

7. GOVERNING LAW & JURISDICTION

These terms are governed by the laws of the State of Arizona, USA. Any legal action must be filed in the courts located in Maricopa County, Arizona.

8. ENFORCEMENT & REVOCATION

We reserve the right to revoke certification and access to our platforms at any time for misuse or violation of these terms.

9. THIRD-PARTY SERVICES & LINKS

9.1 Payment Processing

We use third-party payment processors (such as Shop Pay, Stripe, or PayPal) to process transactions. When you make a purchase, you are also subject to the terms and conditions and privacy policies of these payment providers. We are not responsible for:

Payment processing errors or failures
Unauthorized charges resulting from security breaches of third-party services
Disputes with payment processors

10. REFUND & CANCELLATION POLICY

10.1 Digital Products

Because the Christian DISC® Assessment is a digital product delivered immediately upon purchase (via PDF download or online access), all sales are final. We do not offer refunds except in cases of:

Technical errors preventing you from accessing your purchased assessment
Duplicate charges or billing errors
Other circumstances at our sole discretion

10.2 Requesting a Refund

10.3 Certification Program

Refunds for the Certification Program are handled on a case-by-case basis. Once you have accessed course materials or completed any portion of the training, refunds may not be available.

We do not warrant that:

The Website will be uninterrupted, secure, or error-free
The assessment results will be accurate, complete, or applicable to your specific situation
Defects in the service will be corrected

11.2 Limitation of Damages

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CHRISTIAN DISC®, CHRISTIAN COUNSELING & COACHING LLC, OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Personal injury or emotional distress arising from use of the assessment
Damages exceeding the amount you paid for the assessment or service

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

11.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability will be limited to the maximum extent permitted by law.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Christian DISC®, Christian Counseling & Coaching LLC, and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

Your misuse of the Christian DISC® trademark or intellectual property
Your use or misuse of the assessment or related materials
Your violation of any third-party rights
Any content you submit or actions you take using our services

13. PRIVACY & DATA PROTECTION

This Legal Notice and any disputes arising out of or related to your use of the Christian DISC® Assessment or Website shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.

14.2 Jurisdiction & Venue

You agree that any legal action or proceeding related to this Legal Notice or your use of our services shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona. You consent to the personal jurisdiction of these courts and waive any objection to venue.

14.3 Informal Resolution

Before filing any legal claim, you agree to first contact us to attempt to resolve the dispute informally. Please send a detailed description of the dispute to the contact information provided on our Website. We will work in good faith to resolve the matter within 30 days.
